>> as congresswoman harmon is talking we are getting word that dzhokhar tsarnaev has been transported from beth israel hospital to prison. we are talking about his physical condition. apparently it's upgraded to the point they have taken him out of the hospital new and he has been moved to a prison in massachusetts. one of the people we haven't talked about a lot but we have heard about is this guy who was car-jacked a week ago. he is a 26-year-old chinese man in this black mercedes suv and come to boston to go to grad school and now working on a start-up. he lives in boston . he gets car-jacked around 11:00 last thursday night and taken on an interview with "the boston globe " a 90-minute ride. remember it was reported 30 minutes ? he says it's 90-minute ride. you have to talk about this key to these two brothers being caught. he said finally after this 90 minutes they realized they don't have enough gas to get to manhattan and pull up to a gas station and turns out it's cash only. so they have to go inside. one of the brothers has to go inside the gas station to pay. at that point, this guy who calls himself danny, didn't want to give his real name, makes a decision even though the other brother is in the back seat that is going to bolt. this is life and death . he unbuckles the seat belt and he said he ran in an angle that would be hard for the brother to shoot him. he runs across the street to another gas station and tells the attendant to call 911. he left his iphone in the car so it could be tracked and traced. it's a remarkable account if you have a chance to read "the boston globe " about two and a half hour interview where he gives a moment-by-moment recap and he is critical to these two guys being caught.

>> no doubt. that is when everything started unraveling for them and there was even the moment where his friend kept calling him up and he said if you speak in mandarin, i'm going to kill you right here. you get to the part where the brother was doing an english mandarin translation to tell him what to text back to his friend and the guy just kept his head and was responsible for these two terrorists being caught.

>> the reason the i phone was left in the car? the two brothers wanted to listen to music so he plugged in his iphone to the car.

>> yeah. the nypd has a lot of tools that other local police departments may have to learn about. of course, new york is a much bigger target and so is washington. perhaps than boston or someplace in the midwest. but they have a thousand intelligence officers . they have a huge police department . 35,000 people compared to 2,000 in boston . i think that's the number. obviously, a bigger population. but they can detect signs early. for example the older brother was thrown out of his mosque and there was behavior there they would pick up because they built trust with the muslim community . let's be clear that all would-be radicalized people are not muslim but nonetheless they can pick up signs and follow these people much more closely and they have thwarted a lot of plots. we have been successful more than we have failed in blocking plots against our country.

FAA orders inspection of Boeing 737 tail planes

(Reuters) - The Federal Aviation Administration (FAA) has ordered an inspection of more than 1,000 U.S.-registered Boeing 737 jets to examine the tail planes for a potentially faulty part, which it said could cause pilots to lose control of the aircraft if it failed.

The airworthiness directive (AD) issued by the FAA calls on airlines and other operators to replace tail plane fixing pins with improved pins following concerns over how their protective surface coating was applied.

"We are issuing this AD to prevent premature failure of the attach pins, which could cause reduced structural integrity of the horizontal stabilizer to fuselage attachment, resulting in loss of control of the airplane," the FAA said in the directive issued on Monday.

The airworthiness directive was posted on the website of Federal Register (http://link.reuters.com/pyb47t) and was first reported by the Wall Street Journal late on Sunday.

The FAA said the inspection was "prompted by reports of an incorrect procedure used to apply the wear and corrosion protective surface coating to attach pins of the horizontal stabilizer rear spar."

FAA said its directive affects 1,050 aircraft flown by U.S. carriers and may cost up to $10.1 million across the fleet, or up to $9,627 per aircraft.

The directive applies to models including 737-600, 737-700, 737-700C, 737-800, 737-900, and 737-900ER series aircraft.

Boeing could not immediately be reached for comment by Reuters outside of regular U.S. business hours.

As U.S. talks up diplomacy, N. Korea takes hard line

TOKYO (AP) ? The United States and Japan opened the door Sunday to new nuclear talks with North Korea if the saber-rattling country lowered tensions and honored past agreements, even as it rejected South Korea's latest offer of dialogue as a "crafty trick."

U.S. Secretary of State John Kerry told reporters in Tokyo that North Korea would find "ready partners" in the United States if it began abandoning its nuclear program.

Japan's foreign minister, Fumio Kishida, also demanded a resolution to a dispute concerning Japanese citizens abducted decades ago by North Korean officials.

The diplomats seemed to point the way for a possible revival of the six-nation talks that have been suspended for four years.

China long pushed has for the process to resume without conditions. But the U.S. and allies South Korea and Japan fear rewarding North Korea for its belligerence and endless repetition of a cycle of tensions and failed talks that have prolonged the crisis.

Kerry's message of openness to diplomacy was clear, however unlikely the chances appeared that North Korean leader Kim Jong Un's government would meet the American's conditions.

"I'm not going to be so stuck in the mud that an opportunity to actually get something done is flagrantly wasted because of a kind of predetermined stubbornness," he told U.S.-based journalists.

"You have to keep your mind open. But fundamentally, the concept is they're going to have to show some kind of good faith here so we're not going to around and around in the same-old, same-old," he said.

Tensions have run high on the Korean Peninsula for months, with North Korea testing a nuclear device and its intercontinental ballistic missile technology.

The reclusive communist state hasn't stopped there. It has issued almost daily threats that have included possible nuclear strikes against the United States. Analysts and foreign officials say that is still beyond the North Koreans' capability.

While many threats have been dismissed as bluster, U.S. and South Korean say they believe the North in the coming days may test a mid-range missile designed to reach as far as Guam, the U.S. territory in the Pacific where the Pentagon is deploying a land-based missile-defense system.

Japan is the last stop on a 10-day trip overseas for Kerry, who visited Seoul and Beijing as well in recent days.

In South Korea, he strongly warned North Korea not to launch a missile and he reaffirmed U.S. defense of its allies in the region. In China, he secured a public pledge from Beijing, the lone government with significant influence over North Korea, to rid the North of nuclear weapons.

Before returning to the United States, Kerry planned a speech Monday in Japan on the Obama administration's Asia policy.

So far, Republican lawmakers in the U.S. have largely backed the administration's efforts on North Korea.

U.S. Sen. Marco Rubio, R-Fla., told CBS' "Face the Nation" that he was encouraged by Kerry's China visit and that he hoped "we can get the Chinese to care more about this issue.

U.S. Sen. John McCain of Arizona suggested on CNN's "State of the Union" that the U.S. make a counter-threat by using missile interceptors to hit any North Korean missile that is test-fired.

At each stop along his trip, Kerry stressed that the United States wanted a peaceful resolution of the North Korea situation six decades after a cease-fire ended the Korean War.

But North Korea on Sunday served a reminder of the difficult task ahead. Its Committee for the Peaceful Reunification of Korea said the government had no intention of talking with Seoul unless the South abandons its confrontational posture, as the North called it.

Seoul had pressed North Korea to discuss restarting operations at a joint factory park on the border and President Park Geun-hye has stressed peace opportunities after taking power from her more hard-line predecessor, Lee Myung-bak. The presidency expressed regret with North Korea's rebuttal Sunday.

At a news conference in Tokyo, Kerry stressed that gaining China's commitment to a denuclearized North Korea was no small matter given its historically strong military and economic ties to North Korea.

But he refused to say what the Chinese were offering to do concretely to pressure the North into abiding by some of the conditions it agreed to in a 2005 deal that required it to abandon its nuclear program.

"They have to take some actions," Kerry said of North Korea. "How many or how much? I'd have to talk to folks back in Washington about that. But if the Chinese came to us and said, 'Look, here's what we have cooking,' I'm not going to tell you I'm shutting the door today to something that's logical and might have a chance of success."

In remarks to U.S. journalists, Kerry said that under the right circumstances, he even would consider making a grand overture to North Korea's leader, such as an offer of direct talks with the U.S.

"We're prepared to reach out," he said. Diplomacy, he added, required risk-taking and secrecy such as when President Richard Nixon engaged China in the 1970s or U.S. back-channel talks were able to end the Cuban missile crisis a decade earlier.

Given their proximity and decades of hostility and distrust, Japan and South Korea have the most to fear from the North's unpredictable actions.

Kerry clarified a statement he made Saturday in Beijing, when he told reporters the U.S. could scale back its missile-defense posture in the region if North Korea goes nuclear-free.

It appeared to be a sweetener to coax tougher action from a Chinese government which has eyed the increased U.S. military presence in its backyard warily, but which has done little over the years to snuff out funding and support for North Korea's weapons of mass destruction program.

Kerry said America's basic force posture wasn't up to debate. "There is no discussion that I know of to change that," he said.

But he said it was logical that additional missile-defense elements, deployed specifically in response to the Korean threat, could be reversed if that threat no longer existed.

"I was simply making an observation about the rationale for that particular deployment, which is to protect the United States' interests that are directly threatened by North Korea," he said.

Earthquake strikes off Papua New Guinea

A man from Springfield, Mo., called 911 Tuesday night with an interesting problem. He was not happy with his sandwich purchased at a restaurant franchise of a national chain, so the caller dialed a phone number normally reserved for medical emergencies or life-threatening situations. The Springfield News-Leader reports the man, who remains unidentified because he has not been charged or arrested, has had his information forwarded to the Greene County Prosecutor for possible action. Even more astounding, this is not the first time this person has made strange 911 calls.

Secrets of bacterial slime revealed

Apr. 12, 2013 ? Newcastle University scientists have revealed the mechanism that causes a slime to form, making bacteria hard to shift and resistant to antibiotics.

When under threat, some bacteria can shield themselves in a slimy protective layer, known as a biofilm. It is made up of communities of bacteria held together to protect themselves from attack.

Biofilms cause dental plaque and sinusitis; in healthcare, biofilms can lead to life threatening and difficult to treat infections, particularly on medical implants such as catheters, heart valves, artificial hips and even breast implants. They also they coat the outside of ships and boats polluting the water.

Publishing in the Journal of Biological Chemistry, the team reveal how a molecular switch regulates biofilm formation. This new understanding could help identify a new target for antibiotics and prevent other biofilms from forming.

In order to thwart them from causing disease and biopollution, a Newcastle University team have been studying at the molecular level how bacteria form biofilms in the first instance.

They reveal how the master regulator of biofilm formation, a protein called SinR, acts in the model bacterium, Bacillus subtilis.

Richard Lewis, Professor of Structural Biology in the Institute for Cell and Molecular Biosciences who led the research said: "SinR is a bit like a rocker switch, a domestic light switch for instance. In the "down" position, when SinR is bound to DNA, the proteins required to make a biofilm are turned off and the bacteria are free to move. In the "up" position, SinR is no longer bound to DNA and instead interacts with other proteins, and the biofilms genes are turned on."

SinR is a DNA-binding protein that acts to inhibit the expression of proteins required for the synthesis of the molecular glue that holds the biofilm together. The ability of SinR to bind to DNA is carefully controlled by a network of interactions with three other proteins. By the application of X-ray crystallography, the team have determined precisely how SinR interacts with very specific feature of its DNA target.

By understanding how the proteins interact with each other, and with DNA, scientists can look to develop molecules that interfere with these essential processes as a means to stop biofilms from forming.

Disgraced German ex-president charged with corruption

BERLIN (Reuters) - Former German President Christian Wulff was charged on Friday with accepting a bribe in exchange for a political favor, a year after a broader corruption probe forced him to resign from the largely ceremonial post.

Wulff was hand-picked by Chancellor Angela Merkel for the job of head of state in 2010. But he stood down after 20 months when prosecutors said they suspected he had accepted undue privileges and asked parliament to lift his immunity.

Lower Saxony state prosecutors suspect Wulff of lobbying Siemens AG to help market the film "John Rabe" after a movie producer paid Wulff's expenses during a trip to Munich's Oktoberfest beer festival in 2008.

The producer, David Groenewold, faces the same charges of corruption and bribery after footing a bill for Wulff totaling thousands of euros, the prosecutors said in a statement.

Wulff's lawyers said they would seek to clear his name.

"The charge of corruption ... is unfounded," they said in a statement.

One of Groenewold's lawyers told Reuters the charges did not come as a surprise. Earlier this week, they publicly maintained their client's innocence.

Wulff's reputation took a hammering in his time as president when top-selling newspaper Bild accused him of misleading the state assembly over a cheap home loan from a businessman friend. He later apologized for threatening the editor of Bild with "war" if he published the story.

Allegations about free flight upgrades, hotel stays and gifts further undermined his credibility. The media has even invented a new verb -- "wulffen", or "to Wulff", which means being evasive without telling a clear lie.

If convicted, Wulff theoretically faces from 6 months to five years in jail. But it is likely he would get probation.

The former president rejected an offer from prosecutors to settle the case with an out-of-court payment earlier this week.

Delcath says FDA extends cancer system review

NEW YORK (AP) -- Delcath Systems Inc. said Monday that the Food and Drug Administration will take an extra three months to review its experimental treatment for liver cancer.

The company said the FDA will make a ruling on its Melblez system by Sept. 13. The FDA had asked Delcath for more information about the system, and the agency will use the additional time to review that information.

Melblez is designed to treat cancer by delivering high doses of the chemotherapy drug melphalan directly to the liver while controlling exposure of the rest of the body. Delcath has asked the FDA to approve the system for use in the treatment of inoperable ocular melanoma, a cancer of the eye, when it spreads to the liver.

The system is available in Europe under the name Chemosat.

Delcath shares lost 9 cents, or 5.1 percent, to $1.68 in morning trading.

The FDA had been scheduled to make a ruling by June 15. Delcath said a cancer drug advisory panel will meet to discuss the system on May 2. A favorable review could improve the chances Melblez will be approved, although the FDA is not required to follow the advice of its panels.

"America's Got Talent" may not be back on the NBC airwaves until this summer, but the roundup of talent has already begun -- and judges Howard Stern, Heidi Klum, Mel B and Howie Mandel (along with host Nick Cannon) are already hard at work. They took a break from sifting through the talent on Monday morning to join TODAY's Matt Lauer on the plaza to talk about the newly-configured judging panel, whether last year's winners were the right ones, and what kind of bikini top to wear during a water rescue.

Fortunately, the group seems to be getting along famously. "The female energy is there!" crowed Mel B.

"Literally from this television show I'm getting 10 new wrinkles," said Klum, who also sits in judgement on Lifetime's "Project Runway," because I'm laughing all day, because they're all so funny."

"I've taken Heidi under my wing, Matt, and I'm teaching her about judging -- that's why she'll be excellent," declared Stern.?

There is tension, admitted Mandel, but it's a "respectful tension. I don't agree a lot with some of the other judges." He also doesn't always agree with America, saying that last season's winners (the Olate Dogs) were not the best act. "I would have picked another act to win," he said. "But America chose them. ... America is buying the tickets."

As for that water rescue -- ?Klum raced into the ocean while vacationing in Hawaii when her son and one of his nannies were caught in a riptide at the end of March, and she talked about it during the visit. "It just shows you in your life you never know what's going to happen," she said. "In one second, everything and then all of a sudden the next second your son is smooshed by a wave in the ocean." But her kids have been swimming since they were 2 years old, she added, so her son was able to help save himself.

Stern, naturally, learned a different lesson than to teach your children how to swim. "And your top fell off," he noted. "In a rescue, make sure to wear a tight top."

"America's Got Talent" returns this summer on NBC.

Lilly Pulitzer, fashion designer known for floral prints, dies

Lilly Pulitzer, a Palm Beach socialite turned designer whose tropical print dresses became a sensation in the 1960s and later a fashion classic, died Sunday. She was 81.

Pulitzer, who married into the famous newspaper family, got her start in fashion by spilling orange juice on her clothes. A rich housewife with time to spare and a husband who owned orange groves, she opened a juice stand in 1959, and asked her seamstress to make dresses in colorful prints that would camouflage fruit stains.

The dresses hung on a pipe behind her juice stand and soon outsold her drinks. The company's dresses, developed with the help of partner Laura Robbins, a former fashion editor, soon caught on.

"Lilly has been a true inspiration to us and we will miss her," according to a statement on the Lilly Pulitzer brand Facebook page. "In the days and weeks ahead we will celebrate all that Lilly meant to us. Lilly was a true original who has brought together generations through her bright and happy mark on the world."

Her death was confirmed by Gale Schiffman of Quattlebaum Funeral and Cremation Services in West Palm Beach. She did not know Pulitzer's cause of death.

Jacqueline Kennedy, who attended boarding school with Pulitzer, even wore one of the sleeveless shifts in a Life magazine photo spread, and matriarch Rose Kennedy and one of her teenage granddaughters were once reported to have bought nearly identical versions together.

The signature Lilly palette features tongue-in-cheek jungle and floral prints in blues, pinks, light greens, yellow and orange ? the colors of a Florida vacation.

"I designed collections around whatever struck my fancy ... fruits, vegetables, politics, or peacocks! I entered in with no business sense. It was a total change of life for me, but it made people happy," Pulitzer told the The Associated Press in March 2009.

The line of dresses that bore her name was later expanded to swimsuits, country club attire, children's clothing, a home collection and a limited selection of menswear.

"Style isn't just about what you wear, it's about how you live," Pulitzer said in 2004.

"We focus on the best, fun and happy things, and people want that. Being happy never goes out of style," she said.

In 1966, The Washington Post reported that the dresses were "so popular that at the Southampton Lilly shop on Job's Lane they are proudly put in clear plastic bags tied gaily with ribbons so that all the world may see the Lilly of your choice. It's like carrying your own racing colors or flying a yacht flag for identification."

But changing taste brought trouble. Pulitzer closed her original company in the mid-1980s after filing for Chapter 11 bankruptcy. The label was revived about a decade later after being acquired by Pennsylvania-based Sugartown Worldwide Inc.; Pulitzer was only marginally involved in the new business but continued reviewing new prints from Florida.

"When Lilly started the business back in the '60s, she targeted a young customer because she was young," the company's president, Jim Bradbeer, told the AP in 2003. "What we have done is target the daughter and granddaughter of that original customer."

Sugartown Worldwide was bought by Atlanta-based Oxford Industries in 2010.

Pulitzer herself retired from day-to-day operations in 1993, although remained a consultant for the brand.

Pulitzer was born Lilly McKim on Nov. 10, 1931, to a wealthy family in Roslyn, N.Y.

In 1952, she married Pete Pulitzer, the grandson of newspaper publisher Joseph Pulitzer, whose bequest to Columbia University established the Pulitzer Prize. They divorced in 1969. Her second husband, Enrique Rousseau, died in 1993.

"I don't know how to explain what it was like to run my business, the joy of every day," she told Vanity Fair magazine in a story in 2003. "I got a kick every time I went into the shipping department. ... I loved seeing (the dresses) going out the door. I loved them selling in the shop. I liked them on the body. Everything. There's no explaining the fun I had."

Pulitzer, who was known for hosting parties barefoot at her Palm Beach home, also published two guides to entertaining.

"That's what life is all about: Let's have a party. Let's have it tonight," she said.

Dutchman arrested after British woman stabbed to death on houseboat hotel in India

The woman, whose identity has not yet been confirmed, was 24 years old and had been staying on the New Beauty houseboat, one of hundreds of old British floating hotels on the side of Srinagar's celebrated Dal Lake, for 25 days.

The owner, G.M Shoda, said he and the victim had become friends and she was "like a daughter" to him.

The woman and the Dutch tourist were the only guests staying on the houseboat and had been sitting on the deck until midnight when she went to bed. Later, at around 2.30 in the morning, the owner's sons heard an argument and screams, and went to investigate. They said they saw the Dutch tourist leaving the houseboat in a traditional shikara rowing boat and that he capsized and swam to the shore. They then found the victim lying dead in a pool of blood in her room with multiple stab wounds.

Kashmir's Deputy Inspector-General, Afad ul-Mujtaba, told the Telegraph that a Dutch national, Richard De Wit, was arrested for the murder after police stopped a taxi in Qazi Gund, just under 50 miles from Srinagar, at around 4 am this morning.

Mr Mujtaba said reports that the victim had been raped were unconfirmed and that detectives would not know more until a post-mortem had been carried out. People convicted of rape and murder in India can face the death penalty. Last month India passed new tougher laws and sentences for sexual offences following the national outcry over the gang rape and murder of a 23 year old student in Delhi.

Since then two foreign tourists have been attacked, a Swiss woman who was gang-raped as she and her husband camped overnight during a cycling holiday in central India, and a British woman who jumped two floors from her Agra hotel room to flee an alleged sexual assault by the manager.

The police said the British victim and the Dutch suspect had not been friendly with each other and although they were both sitting on the houseboat deck last night [SAT], they had not spoken to each other. "The girl went to sleep at about 12 o'clock and the Dutch man was outside until 12.30am," Mr Mujtaba said. "After that everyone, including the houseboat owner and staff went to sleep. At around 2.30am, they [the owner and his son] heard some cries, possibly some quarrelling."

A knife was found near the victim's body and there was evidence that her room door had been forced open, police added.

Kansas Senate passes new abortion restrictions

KANSAS CITY, Kansas (Reuters) - The Kansas state Senate passed a measure on Friday that would ban Planned Parenthood from providing sex education in schools and require women to get more information about fetal development before having an abortion.

The measure was approved by a 28-10 vote and was expected to pass easily in the House of Representatives, which backed the 70-page bill in largely similar form earlier this week. Republicans have large majorities in both chambers. Republican Governor Sam Brownback, who opposes abortion, is expected to sign it.

Opponents of the measure say it contains 40 provisions that affect a woman's health and intrude on her right to an abortion. Advocates said it mainly codifies existing practices, while helping women make more informed choices.

"This fulfills the legislative intent to create a pro-life state," said Kathy Ostrowski, legislative director of Kansans for Life.

The Kansas bill is the latest development in a national fight over abortion that has seen lawmakers in several states pass new restrictions on abortion in the past two years.

Those have included laws approved in the past month in North Dakota and Arkansas that are seen as direct challenges to the U.S. Supreme Court's Roe v. Wade ruling in 1973 that legalized abortion.

The Kansas bill prohibits use of public funds, tax preferences or tax credits for abortion services.

The bill also requires abortion clinics to provide printed material about the fetus' stages of development, a link to websites, material and organizations that help pregnant women, and an explanation of legal responsibilities for an unborn child.

The bill bars school districts from letting abortion providers such as Planned Parenthood offer, sponsor or furnish course materials or instruction on human sexuality or on sexually transmitted diseases.

The bill defines life as beginning at fertilization, but does not ban abortion from that point.

NY County Uses Recycled Building Materials to Address Aging ...

Recycled plastic and plastic composite building composites are being used to repair and restore bridge decking on a bridge in Clare, New York, a move which will result in 30,ooo pounds of plastic being taken out of the landfill stream, says Axion International Holdings, the maker of the products used in the bridge repairs.

Axion says a second order for 6? x 24? tongue & groove Struxure boards from the St. Lawrence County Department of Highways has been made for the Dean Road Bridge, and that the company is working with the county on two more bridge projects also using Axion products. Struxure products are made from 100% recycled materials, and are long-lasting, durable, and outperform traditional materials because they won?t rust, splinter, crumble, rot, absorb moisture or leach toxic chemicals into the environment, the company says.

The American Society of Civil Engineers? 2009 report states that while $10.5 billion is spent annually on the construction and maintenance of bridges, a $17 billion annual investment is needed to substantially improve current bridge conditions. According to the Federal Highway Administration, 143,899 bridges were either structurally deficient or functionally obsolete in 2011. County and municipal highway departments are faced with the challenge of prolonging the useful life of these bridges and maintaining their safety, and are looking for building products that last and require no maintenance.

St. Lawrence County Superintendent of Highways Toby Bogart says the Struxure boards used as an alternative to stay-in-place concrete forms on a culvert project last year were easy to install and durable through New York?s harsh weather conditions. He also said that the recycled products are a good investment because they are impervious to water and salt and don?t get the wear and tear that traditional materials do over time.

Another project using Axion?s recycled building materials is the railroad tracks used by the Trinity Railway Express between Dallas and Fort Worth. Those tracks include sections using Axion?s Ecotrax railway ties, which are made from a composite of recycled polyethylene plastic and fiberglass, writes the Dallas Business Journal. The ties include millions of pounds of plastic, such as milk jugs, shampoo bottles, and detergent bottles, that would otherwise have gone into a landfill, says Axion president and CEO Steve Silverman. Using these ties, which are lighter than concrete, means the project requires less ballast, says Tim McKay, executive vice president of growth and regional development for Dallas Area Rapid Transit. That means they reduce the overall cost of the railroad.
